T&D Landscape & Design Service and Products Limitted Warranty

Contractor will complete the specified work in a timely and workmanlike manner according to standard practices prevalent in Contractor’s trade in the State of Arizona.

Contractor warrants that:

The specified work shall comply with all applicable local building codes and regulations.
The labor and material provided as part of the specified work shall be free from known defects (manufacturer defects are unknown to the Contractor and must be resolved directly with manufacturer).
45 day warranty on below stated items:

Brick and extruded concrete borders installed by T&D Landscape & Design L.L.C.

45 day one time replacement warranty on below stated items:

Plants

Contractor reserves the right to furnish substitute plants of equal or greater value in cases where designated plants are not available.
Plants not purchased through T&D Landscape & Design L.L.C., will not be covered under warranty.
No warranty is offered on plants not placed in conjunction irrigation installation by T&D Landscape & Design L.L.C.
During warranty period, timer alterations made by customer, to the schedule set by Contractor, will void warranty.
Relocation of plants after installation by anyone other than a duly authorized T&D employee will void warranty.

45 day warranty on below stated items:

Trees

Trees not purchased through T&D Landscape & Design L.L.C., will not be covered under warranty.
No warranty is offered on trees not placed in conjunction with irrigation installation by T&D Landscape & Design L.L.C.
During warranty period, timer alterations made by customer, to the schedule set by Contractor, will void warranty.
Relocation of trees after installation by anyone other than a duly authorized T&D employee will void warranty.

1 year warranty on below stated items:

Irrigation-Water systems have a one (1) year parts guarantee provided however that the Contractor’s sole responsibility shall be replacement or repair, and in no event shall Contractor be liable for incidental and/or consequential damages.

Water features and lights are tested and customer signature approves as operative upon project completion; no further warranty is offered.
No warranty is offered on below stated items:

Sod, concrete, masonry, water features

Below stated items do not carry a warranty through T&D Landscape & Design L.L.C., however, may be covered under direct warranty with the manufacturer (Customer is responsible for contacting the item manufacturer directly for resolution):

Irrigation timers, water pumps, lights, wrought iron, barbeques, refrigerators.

Items requiring service after the warranty expiration period, and/or items not covered under warranty, will be serviced at a charge of $75.00 up to the first man hour and $45.00 per man hour thereafter, plus required materials.
T&D Landscape & Design L.L.C. is not responsible for grading or damage due to builders and association set grade unless otherwise specified.
Warranty items will not be performed unless Contractor has been paid in accordance with payment schedule.
Homeowner agrees to pay a charge of $75.00 for the first man hour and $45.00 per man hour thereafter, plus required materials, if warranty call is proven to be a result of non warranty reasons.

The Contractor and Homeowner recognize that:

T&D Landscape & Design L.L.C., is not responsible for damage caused by acts of weather and/or natural causes.
Contractor’s original cost, time and/or material estimates may prove too low due to a multiple of reasons, unforeseen events or factors. Related additional costs will be the responsibility of the homeowner.

Projects cancelled within 3 business days of start date are subject to a charge of 10% of total contract price.
